TERMS AND CONDITIONS & PRIVACY POLICY 1. OVERVIEW 1.1 This website (www.matenniscoaching.com) is the property of Marc-Anthony Lopez, referred to as MA Lopez. The purpose of this website is to showcase MA Lopez’s tennis coaching services, as well as outline his previous experience in the tennis industry. 2. TERMS 2.1 Acceptance: By accessing this site, as a user you agree to these terms and conditions. 2.2 Changes: If any of these terms and conditions are changed, users will be notified. 3. SERVICES 3.1 Junior/Adult Group Coaching 3.1.1 Payment in Advance: Group Coaching lessons must be purchased as part of a 3/6/12 week bundle and are no longer offered on a pay-as-you-go basis. This is to avoid last-minute cancellations and no-shows, which can cause the lesson to be cancelled for other members. 3.1.2 Payment Options: Payment must be made 24 hours before the first lesson of the bundle takes place. Payments can be made to the bank account details outlined in the payments page of this website. 3.1.3 Cancellations/No-Show Policy: If you are unable to make a session, you must contact MA Lopez 24 hours before the session. You will not be charged for this session, and your lesson will roll on to the following week. Absences within 24hr notice will still be charged and this will count as one of your bundle lessons. This method ensures that even if some students from the group cannot attend at short notice, the lesson can still go ahead for those available. 3.1.4 Weather Cancellations: Coaching sessions will be cancelled with a minimum of 2 hours notice if weather conditions are at a point where carrying out the session could be unsafe for members to play in. Please do not assume a session is cancelled if it is raining, any cancelled sessions will be notified via the WhatsApp group for the session. You will not be charged for this session and payment will roll on to the following week. 3.2 Junior/Adult Individual Coaching 3.2.1 Payment in Advance: Individual Coaching lessons can be purchased as either part of a 6/12 week bundle or as a one-off session and are no longer offered on a pay-as-you-go basis. This is to avoid last-minute cancellations and no-shows, so that MA Lopez’s time is respected and valued appropriately as a coaching professional. 3.2.2 Payment Options: Payment for one-off sessions must be made a minimum of 24 hours prior to the session. 6/12 week individual sessions must be purchased as a bundle 24 hours prior to the first session you want to attend. Payments can be made to the bank account details outlined in the payments page of this website. 3.2.3 Cancellations/No-Shows: If you are unable to make a session, you must contact MA Lopez 24 hours before the session. You will not be charged for this session, and your lesson can be rearranged. Absences within 24hr notice will still be charged and this will count as one of your individual bundle lessons. 4. ELIGIBILITY 4.1 Age Range: Children must be within the labelled age bracket to attend the relevant group coaching session. Anyone aged 18 and over will be charged an adult fee. 4.2 Location: All coaching sessions take place at Busbridge Tennis Association, Godalming, Surrey. You must be able to access the location to attend the sessions. 4.3 Skill/Tennis Ability: Your child must be of a suitable ability to attend a group coaching session. If your child is too advanced or not at the level to match the remaining group members, it will be recommended to either move to a different class or take individual lessons to get up to speed. This ensures a fairness for the other group members so that everyone is of a similar tennis ability. 5. CLIENT’S RESPONSIBILITIES 5.1 Behavioural Expectations: 5.1.1 Junior Coaching: Parents/guardians are responsible for the behaviour of their children when attending both group and individual coaching sessions with MA Lopez. If your child displays consistent acts of misbehaviour, such as disrespectful language, lack of participation, bullying or any other forms of disruption to the lesson, you will be informed and asked to handle this behaviour privately while taking absence from future sessions. No bundle payments will be refunded in this case as this is not at the fault of MA Lopez. 5.1.2 Adult Coaching: Adults are expected to conduct themselves in a respectful and appropriate manner while attending both group and individual coaching sessions. Any aggressive, disrespectful or homophobic behaviours will not be tolerated and you will be asked to leave a group session immediately or your individual session will be terminated. No refund will be issued in this case. 5.2 Equipment: 5.2.1 Use: All tennis equipment used during sessions (excluding own tennis rackets) is the property of MA Lopez and should be used only for the intended purposes and with respect. 5.2.2 Damage: If you or your child causes damage to any equipment, it will be your responsibility to fund the cost of a replacement. This excludes individual tennis balls. 5.3 Busbridge Tennis Association 5.3.1 Adherence to Club’s Rules and Policies: MA Lopez is a tennis coach at Busbridge Tennis Club which owns the tennis courts. It is your responsibility to adhere to the rules and policies set out by Busbridge Tennis Association when attending coaching sessions with MA Lopez. You will be held responsible by Busbridge Tennis Association for any property/court damage and will be in no way affiliated with MA Lopez. 5.3.2 Membership: Adults and children attending coaching sessions with MA Lopez at Busbridge Tennis Association must hold an active membership with the club. MA LOPEZ’S RESPONSIBILITIES 6.1 Provide Coaching Sessions as advertised: MA Lopez will run all coaching sessions scheduled and paid for by members on a weekly basis, unless cancelled due to the client or due to unsafe weather conditions. 6.2 Support the Learning of Clients: MA Lopez will use his expert knowledge and training experience to provide high quality tennis coaching services to paying members. 6.3 Cancel Sessions due to Unsafe Weather Conditions: MA Lopez will cancel any coaching sessions within a minimum 2 hr notice period if weather conditions are unsafe to carry out the session to prevent any risk of injury to clients. 6.4 Provide Notice of Session Cancellation due to Illness/Unavailability: MA Lopez will provide notice of session cancellation within a minimum 24 hr notice period due to personal reasons such as illness/unavailability. You will not be charged and the session will be rearranged at your earliest convenience. 6.5 Safety: MA Lopez has completed First Aid Training and is qualified and authorised to perform first aid to any clients when aid is required in relevant cases. MA Lopez has undergone a DBS check and has met the suitability to teach children. 6.6 Behaviour: MA Lopez will conduct himself in a professional and appropriate manner. 7. ADDITIONAL ABSENCE POLICY 7.1 Holiday: Lessons will continue throughout school holiday periods excluding the week of Christmas. Please let MA Lopez know if you will be away during holiday periods in advance and your lesson will be rolled on to the following week. 7.2 Sickness/Injury: If your child will need to take a prolonged time of leave from coaching due to sickness/injury or any other personal reasons, please let MA Lopez know and your lesson bundle will be paused until an agreed later date. 8. CONTENT USAGE 8.1 Photography and Online Media: Any images or other forms of media taken during coaching sessions will only be implemented following completion of a signed consent form by a parent/guardian. Any forms of media created will be solely used for this website and no other media platforms. 8.2 Content Restrictions: All photos used on this website are the property of MA Lopez and can not be used for personal use, copying, redistribution or commercial use. 9. PRIVACY & DATA PROTECTION 9.1 Personal Data: Personal Data acquired through signing up for coaching sessions will be stored securely and only used for intended purposes. 10. LIMITATION OF LIABILITY 10.1 Disclaimers: By booking coaching sessions with MA Lopez, you forgo liability against MA Lopez for any errors or issues with the website, including any inaccuracies in the coaching materials or results from the lessons. 10.2 Indemnity: By booking coaching sessions with MA Lopez you agree to hold MA Lopez harmless for any losses, damages, or legal issues arising from their use of this website or services. 11. TERMINATION 11.1 Payment Failure: If you fail to provide payment in advance for one or more coaching sessions with MA Lopez, you will not be able to attend the session nor any sessions moving forward until the debt has been cleared. If you refuse to issue payment for coaching services your sessions will be cancelled and you will not be able to book any further coaching services. 11.2. Misconduct Consequences: Any clients who engage in behaviours which breach the responsibilities outlined in the “Client Responsibilities” section 12.
